TERMS OF USE & USER AGREEMENT

1. ACCEPTANCE OF TERMS

By using GUBER, you agree you have read and accepted these Terms. You must be 18 or older to use the platform. GUBER may update these Terms at any time, and continued use of the platform means you accept any changes.

2. OUR MISSION

We believe in fair, equal, and safe opportunities for all people regardless of background.

3. INDEPENDENT USER RELATIONSHIP

All users are independent contractors, not employees. Users:

• Set their own rates
• Choose when and if to work
• Provide their own tools
• Pay their own taxes

Nothing in GUBER creates employment, partnership, or joint venture status between GUBER and any user.

4. GUBER’S ROLE & LIMITATIONS

GUBER is a technology platform for connecting Users. We do not supervise work, guarantee outcomes, or control pricing.

Private Job Waiver: Each job is a private agreement between Users. GUBER is not a party to that agreement.

5. FULL LIABILITY WAIVER & RELEASE

Users assume all risks when interacting with others. To the maximum extent permitted by law, GUBER is not liable for:

• Injury or death
• Theft or property damage
• Fraud or criminal actions
• Emotional distress
• Lost income
• Negligence by Users

6. ILLEGAL ACTIVITY

Strictly prohibited on GUBER:

• Drugs or weapons
• Sex work
• Trafficking
• “No questions asked” jobs
• Scams or fraud
• Trespassing or other illegal services

Violations may be auto-blocked and reported.

7. SAFETY & CONDUCT

Users must:

• Behave respectfully
• Act lawfully
• Meet in safe/public places whenever possible

Harassment, hate speech, threats, or unsafe behavior may result in immediate suspension or permanent removal from the platform.

8. NON-DISCRIMINATION & FAIR CHANCE POLICY

No discrimination is allowed based on identity or background, including race, color, gender, gender identity, disability, sexual orientation, religion, or similar protected characteristics.

A prior conviction does not automatically ban a helper unless there is an active safety risk.

9. AUTOBLOCK SAFETY SYSTEM

GUBER may instantly block jobs or users involving:

• Violence or threats
• Scams, fraud, or exploitation
• Dangerous or clearly illegal acts

10. PAYMENTS, PLATFORM FEES & TAXES

• Payments are handled by third-party processors (e.g., Stripe).
• GUBER does not hold funds or guarantee payments.
• A platform Service Fee (e.g., 20%) may be earned when a match or job agreement occurs.
• No refunds are provided for job disputes once a match occurs.
• Users are responsible for their own income taxes and reporting.
• Off-platform payments are prohibited and may lead to suspension or removal.

11. USER DISPUTES

Disagreements, cancellations, and disputes are strictly between Users. GUBER does not:

• Mediate disputes
• Guarantee payment
• Provide insurance or coverage for losses

12. PLATFORM MISUSE

GUBER may remove or suspend accounts for:

• Fake profiles or misleading information
• Spam or harassment
• Fraudulent behavior or scams
• Attempts to avoid platform fees or move transactions off-platform

13. RATINGS & ACCOUNT STATUS

Ratings and feedback may affect your visibility, trust level, and standing on the platform. Accounts may be removed for repeated complaints, low ratings, or serious violations of these Terms.

14. INTELLECTUAL PROPERTY

Users own their own content but grant GUBER a non-exclusive, worldwide license to use, display, and distribute that content as needed to operate and promote the platform.

All GUBER branding, including names, logos, and designs, remain exclusive property of Guber Global LLC.

15. SAFETY TIPS

GUBER may provide recommendations and safety tips, but they do not guarantee safety. Users must exercise their own judgment, verify information, and prioritize personal safety at all times.

16. ARBITRATION & CLASS ACTION WAIVER

Any disputes, claims, or controversies arising out of or relating to your use of the platform will be resolved by binding arbitration, rather than in court, except for claims that may be brought in small claims court.

You waive the right to:

• Participate in class action lawsuits
• Have a jury trial

17. GOVERNING LAW

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles.

18. TERMINATION & ENFORCEMENT

GUBER may suspend or remove Users at any time, with or without notice, for:

• Safety concerns
• Fraud or suspected fraud
• Illegal activity
• Violations of these Terms or other platform policies
